well as new reports of an accident through the altamont pass. good morning, it's thursday october 4. i'm frank mallicoat. >> i'm michelle griego. time now is 6:00. president obama and republican challenger mitt romney will campaign in bryan stows today after having their say at their first -- battleground states after having their say at their first debate. 47% believe romney won compared with 34% for president obama in a survey of californians. 18% felt there was no clear winner. last night's debate focused on the economy and other domestic issues. and, of course, that debate took place in denver in colorado. colorado is a swing state. different surveys show mitt romney is the winner of the first debate.

there are two more presidential debates coming up. bigad shaban has highlights. >> reporter: good morning. it seems like mitt romney got the boost he was hoping for after putting the president on the defensive for much of the night. romney touted his own accomplishments as governor of massachusetts but continually pointed to what he called the failed promises of the obama administration. >> reporter: the first presidential debate started with a handshake and a romantic moment. >> 20 years ago, i became the luckiest man on earth because michelle obama agreed to marry me. >> congratulations to you, mr. president, on your anniversary. i'm sure this was the most romantic place you could imagine here with me. >> reporter: the theme of the debate for president obama appeared to be that romney's plans lacked specifics. >> is the reason that governor romney is keeping all these plans secret because it's too good? >> reporter: governor romney spent the night attacking his record. >> you have been president for four years. you said would you cut the deficit in half. it's now four years later. we still have trillion dollar deficits. >> reporter: mitt romney came into the debate trailing in the polls but that could change

after last night's performance. >> anytime a challenger stands on the stage with the president in a first debate they tend to get a bounce. i expect that could happen here. >> reporter: the romney campaign believes the governor scored a knockout. >> i believe that governor romney was the clear winner of this debate. if it was a boxing match it would have been called. >> reporter: an instant cbs news poll chose romney the overwhelming winner. 46% of the people we surveyed said romney won the debate. but moderator and pbs anchor jim lehrer might not feel the same way. >> i'm sorry, jim, i'm going to stop this subsidy to pbs. i'm going to stop other things. i like pbs. i love big bird. i actually like you, too. but i'm not going to keep on spending money for things we have to borrow money from china to pay for. >> reporter: they will square off again october 16. the vice-presidential candidates will soon get their chance. their first and only debate is set for next thursday. in denver, i'm bigad shaban. now back to you.

>> thank you. well, trending now on social media, the comment that romney would fire big bird. it gained 25,000 followers on twitter overnight. less than 30 minutes ago, he thanks governor romney for making his account so popular so a little bit of fun there. president obama and mitt romney weigh in on the issues in an exclusive presidential for trum on cbssf.com. today's issue much like last night, the economy. some developing news in san jose where investigators are still on the scene of a deadly shooting. cbs 5 reporter anne makovec is in east san jose with details. >> reporter: i'm at the scene of san jose's 36th murder of the year. no suspects in either case. the one that happened here

about 12:30 this morning a birthday of party going on and the manwas shot was tending the barbecue at around 12:30 a.m. a witness said suddenly four people came up to him, ambushed him. they were wearing blue bandanas according to this man on their face and one of them started shooting hitting that man who was tending the barbecue. he was around 30 years old. that man then ran into the house and he died here on the scene. police think this may be gang- related. but the friend of the man who died said no one at the party was affiliated with a gang. >> he was a family man. he was not a gangbanger. he was not a violent person. he wasn't a person to cause trouble with anybody. he was a very friendly guy, very funny person, very charismatic. >> reporter: san jose's 35th homicide of the year happened a few hours earlier two blocks from san jose state in downtown san jose on south second street at around 8:30 p.m. police say there had been a fight. when they got there a man was unconscious and not breathing.

he was taken to the hospital, where he died. and police have not released the names of either of those who died until the families are notified. live in san jose, anne makovec, cbs 5. a rush hour confrontation tied up caltrain service around the diridon station in downtown san jose. a san mateo county sheriff's deputy on patrol for caltrain shot and wounded a 29-year-old san jose man acting strangely and laying on the tracks. the deputy followed the man down the tracks and then called for backup. investigators say the man armed himself with some rocks and possibly a railroad spike. >> the suspect displayed some type of threatening behavior toward the officers that the san mateo county sheriff's deputy believed was a danger to his safety and that of the other deputies and he fired several rounds at the suspect. the suspect was struck twice. >> that suspect is expected to face assault charges when he gets out of the hospital. police in vallejo are investigating the deaths of two

men in a neighborhood dispute. neighbors on folkstone way reported hearing six to eight shots last night. police say it appears one neighbor carrying a firearm crossed the street to confront the two victims in a driveway. the suspect, a 65-year-old man, was arrested. court-appointed monitor says the response by oakland pd to "occupy" oakland last fall was troubling. the monitor robert warshaw says police were understaffed and unprepared to confront protestors who tried to reoccupy a camp at city hall. warshaw says he will now watch carefully to see whether the department makes reforms that were recommended in an earlier report that came out this past june. 6:06. let's check the weather. it's freezing in here! >> it cannot be any colder outside than it is under this air-conditioning vent. but not to vent myself, we need earmuffs in the studio. for you folks out the door bring a jacket or sweater.

it's going to be chilly compared to yesterday. so we're seeing a lot of 50s, a few low 60s. 60 degrees in oakland. mid-50s in pacifica and about 59 degrees in the north bay in parts of san rafael. if you thought yesterday felt a bit cooler you will notice even more dramatic difference by later on this afternoon. the temperature spread will be anywhere from 10 to 20 degrees cooler this afternoon than what we saw yesterday. we have a sea breeze kicking in and just to give you some examples, santa rosa was in the triple digits on tuesday and then this afternoon's highs only in the low 70s. so it's going to get cooler still by saturday and sunday. we're beginning a cooling trend. we'll have the seven-day forecast with a slight chance of rain so stay tuned for that. in the meantime, let's go to gianna talking about major bart delays. >> and a couple of accidents on th freedoms. bart delays continuing from an earlier problem of a maintenance vehicle stuck on the tracks in oakland.

not another emu. >> he is a little confused. >> police tried to get him off the highway without success. finally the bird's owner got him off the road by throwing a towel over his head. poor emu. 5 feet is about as tall as me. >> they needed a hose or another emu. this afternoon, the blue angels will begin practicing above san francisco bay. >> look to the skies. scheduled to perform in the air on saturday and sunday but today and friday they are going to do some practice sessions around 12:30 to 4:00. blue aingels will take off from oakland airport and airport officials are telling neighbors to expect noise levels. fleet week could create gridlock over the weekend as well as the america's cup series. the hardly strictly bluegrass festival starts friday at golden gate park. throughout the weekend, the giants are playing a couple of

play-off games and 9ers hosting the bills on sunday at candlestick park. for more information on the events go, to cbssf.com/weekend. and traffic-wise, bart is a really good option. >> yeah. no kidding. but bart saw some delays this morning, gianna. >> in fact i have better news to report. things are better. we are now hearing that only residual delays of 5 to 15 minutes. so up to an hour at one point this morning. things are definitely getting back on track. that morning commute starting to heat up. here's a live look at the bay bridge toll plaza and you can see traffic is stacked up. no word if they have turned on the metering lights but thank goodness bart is getting back on time. if you are going across the bay bridge this morning, here's a live look at conditions via our a.c. transit cam. traffic is moving okay past the incline and on the upper deck of the bay bridge. we have a couple of trouble spots out there and again, bart five to 15 minutes right now. rest of mass transit right on time. we have this accident westbound 580 just as you approach the

dublin interchange. it is blocking the right lane causing some delays in and around the area. bumper to bumper in some spots approaching the tassajara area so give yourself some extra time. looks like it is improving just a little bit through there but, of course, when these accidents happen along 580 it makes problems in the altamont pass. the damage is done. westbound 580 a 26-minute ride from the altamont pass to the dublin interchange. we have a couple of things brewing in the south bay. we have reports of an accident along 101 northbound at old oakland road, blocking languages. great america park off-ramp from the freeway from 101 is blocked as they clear an accident there as well so very busy. 280 though still holding steady northbound no delays through downtown san jose. and elsewhere we are starting to see brake lights as you go westbound highway 4 through antioch. so very busy. let's check your forecast once you head out. here's elizabeth. >> sounds like traffic is heating up. weather is cooling down. quite a bit cooler in fact.

you will notice the temperature difference out the door. that chill is in the air. it's definitely fall outside. low clouds around the bay temperatures in the 50s. this afternoon highs in the 60s around the coast and the bay. and going to warm up to this 70s to very low 80s inland spots. today will be cooler than yesterday. sea breeze kicking in with a low off the coast bringing us cooler weather. kind of breezy conditions especially by later on this afternoon. i noticed the breezes kicking up in san francisco even as early as yesterday. so pinpoint forecast, 70s this afternoon, greens and yellows in our color-coded guide so in the south bay mainly mid- to upper 70s. hot spots east of the oakland hills. more comfortable in walnut creek and concord.

mid- to upper 70s there. at the coast and the bay no longer any beach weather for the coastal areas, only high of 60 degrees in bodega bay, 59 in stinson beach and then a lot of 60s in place like alameda, oakland, and berkeley. going to reach into the mid-60s there. we're in the beginning of a cooling trend so it's going to stick around for tomorrow. saturday and sunday cooler still only going to reach into the upper 70s in some of our warmer areas. mid-60s around the bay. monday we got slight chance of rain about 20% chance right now but it's going to be kind of an overcast start for the beginning of the next workweek. we'll have an update on your workweek. traffic and weather together every 10 minutes. turkey just announced syria has admitted to shelling a turkish village and reportedly apologized for the five civilian deaths near the border between the two countries. it appears to be an accident as syrian government forces continue to fight rebels who are trying to oust the regime

income tax who consider themselves victims. and they say had the president went ahead and mentioned that, that could have helped basically distinguish himself from romney as someone who better understands the middle class and the problems they are going through. >> they both hit the campaign trail again. a lot of work to do. 36 days before the big election. bigad shaban, live in denver, tough. even people in heavily democratic california say romney won the debate. a cbs 5-surveyusa poll of adults in the golden state said 48% said romney won compared with 34% for president obama. 18% felt there was november clear winner. starting today -- there was no clear winner. starting today they weigh in on issues on an exclusive presidential forum on cbssf.com, today's issue, the economy. i'm going to buy everyone parkas because the ac in the studio is flying. it's chilly. >> it's chilly inside. it should be a toss-up to see whether it's chillier inside or

out the door now. bring a jacket as you head out the door or a sweater. temperatures are going to feel cooler. and if you notice that shot, got some low clouds and fog now moving over parts of the bay. temperatures mainly still in the 50s. still 60-degree reading in oakland but for the most part, 50s. 58 in san francisco. and 57 degrees in parts of san jose. so yeah, by this afternoon, temperatures are only going to reach into the 70s in the south bay. so a lot of areas saw triple digits on monday and tuesday. well, all that is out of here. our heat wave is now over. and a cooling trend is on the horizon. so we are going to see our warmest areas mainly east of the oakland hills. so antioch, brentwood, reaching 80 degrees there. otherwise a little more comfortable in walnut creek into the mid- to upper 70s. a lot of 60s around the coast and bay. so beach weather no longer the case. coming up we'll get a check of the seven-day forecast. we are putting a chance of rain in it. so stay tuned for that. in the meantime, gianna has been busy on the computer monitoring a lot of

information. >> it has been a busy morning. we have live pictures right now from this accident in santa clara. this is northbound 101 great america parkway off-ramp. it's completely shut down while they retrieve a vehicle that went over the side. lots of emergency crews on scene as you can see in our live shot here. getting reports that a person may be trapped in the vehicle so no word on how long this will take. in the meantime the great america parkway off-ramp from north 101 is completely shut down as a result. so we'll keep you updated on this. now, let's jump to our maps. there are a few hot spots in the south bay. another accident along 101 northbound at oakland road. this one is blocking languages. you can see traffic really slow and go as you work your way through there. better news though for bart. we are seeing delays five to 15 minutes now after an earlier problem. that's a look at your morning drive. back to you guys. thank you, gianna. 6:36 now. some developing news in san jose where suspects in two murders still on the loose this morning. cbs 5 reporter anne makovec is in east san jose where she just talked with a friend of the city's latest murder victim.

anne. >> reporter: this is the scene of san jose's 36th homicide of the year. it happened at about 12:30 this morning. there was a birthday party going on at the home here behind me. one man was outside tending a barbecue when apparently, a group of maybe about 4 people came upon him and started shooting. he ran into the house screaming and then died in that house. police think that this crime may be gang-related. but the friend of the mandied who was in his 30s says no one at the party was affiliate with a gang. >> guys cook a barbecue ran into the house saying shots fired. the man who was hit ran into the house and dropped to the floor. i looked out the window and i didn't see anything. all i was told is that it was gangbangers wear blue rags on

northbound 101. they are tending to an injured person. the person was reportedly trapped in the vehicle. so that off-ramp is completely shut down while they work on the injury accident in santa clara and clear the vehicle from the embankment. so give yourself some extra time. we are seeing delays along 101 as well because of the accident as well as the off-ramp being shut down. there is an accident not far from there north one one at oakland just south of there. that's causing delays, as well. on the bay bridge you can see traffic is very slow. we have the metering lights on, also stalled vehicle reported near yerba buena so it is blocking lanes. the right lane is blocked slow and go there, as well. it gets better once you head into san francisco just on the skyway there off of the upper deck of the bay bridge. better news for bart, as well. all trains are now back on time. we were dealing with delays this morning up to an hour at one point due to a broken-down maintenance vehicle on the trafficks. everything is now on time. ace, muni, caltrain, ferries,

no delays. south 880 at lewelling blocking lanes, traffic loading up as a result. 880 northbound not too bad. looking okay working your way through downtown oakland towards the maze. no major delays until you hit the maze and the bay bridge. 880/237, we are starting to see some brake lights, as well. traffic loading up as you work your way through milpitas. westbound 237. an earlier problem westbound 580 at 680 was blocking lanes now cleared. but the damage is done. 33 minutes now westbound 580 from the altamont pass to the 680. antioch slow as well, westbound highway 4. and a quick live look at the san mateo bridge. one of our bright spots right now. a little busy on the westbound side but overall traffic moving okay in both directions. that's a look at your morning drive. elizabeth? >> it has been very busy in traffic. we're cooling things down over here in the weather department this morning. here's a look at your weather headlines across the bay area. you may need your heating heading off to work. it's a cooler start and we are just beginning this cooling trend. it's going to be cooler still

by the weekend so saturday and sunday we got some low clouds and fog moving in and it looks like it's sticking around for the next several days. we are watching this low off the coast. it's a sea breeze. you may have noticed some breezy conditions as well by this afternoon. notice it was breezy in san francisco as early-morning as yesterday afternoon. so yeah, those triple digits are completely out of here. our heat wave is officially over. a lot of 70s especially in the south bay. you're going to see some upper 70s in parts of san jose. so may feel a little more comes in places like walnut creek, concord 77 your high there. otherwise, the hottest spots will be east of the oakland hills so antioch, brentwood, we will reach into the low 80s. but that's about it. otherwise no longer beach weather in bodega bay, stinson beach only in the 50s to very low 60s. and then a lot of 60s around the bay, as well. let's see, 62 in sausalito. mid-60s in berkeley and alameda. here's that cooling trend. your forecast, over the next several days looks something like this, kind of a similar

nevertheless one billion is a sizabl benchmark. the stock is up about 1.25% just over $22. the economy in view today. weekly jobless claims jumping 4,000 to 367,000, four-week average flat at 375,000 indicating that hiring is still tepid. we get the september jobs report tomorrow. critical report and expecting a gain of over 100,000 jobs by the economy, just not enough. retailers posting decent numbers for september heading closer to the holiday shopping season. couple of bay area retailers doing well, gap sales across three chains up 6% and ross was up 5%. let's check the markets. dow is gaining 40 points. nasdaq heading higher by 3. s&p up by 5. another rough day for hewlett-packard. its shares down by 3.5%. yesterday they dove 13% after ceo meg whitman told analysts that the turnaround is going to

last night my family ate dinner around the tv last night which we never do. let's share your take on some of the moments that maybe are considered memorable. >> you can't deny that the fight between mitt romney and the moderatedder over the timing and how the debate was going to flow was something that even in the media filing room we all sort of physically react to after a while. it got a little uncomfortable. i understand we have a clip of one of the moments. >> yeah. let's take a look. >> the president began this segment so i think i get the last word. so i'm going to take it. >> you get the first word in the next segment. was saying were the same things he has been saying for a year, which makes the fact that barack obama didn't have much in the way of comeback for the things that mitt romney was saying, that much more "interesting." basically, there was the famous big bird line where mitt romney said he would defund public broadcasting. he has been saying that since november of 2011 saying he is going to defund the national endowment for the arts. they fell flat and obama didn't have a response. also, mitt romney's critique of obamacare, the $716 billion cuts to medicare. these are things that obama really didn't have a response for. and again he should have because mitt romney's been telegraphing this for the past year. it was a big disappointment for people watching. >> and in fact, melissa, the president even said, well, i -- i'll adopt that term obamacare. he agreed with it. >> reporter: he seems to really enjoy it. it's there for better or worse

anyway. i can tell you inside the the media room, there were lots of interesting things happening. again lots of international media there people from china, france, germany, an exciting place to be last night. i think obama though knew that something was off. his final two-minute speech was really deflated really flatfooted and i spoke to several security guards right after the debate who told me that obama jetted out very, very quickly after the debate was over even more quickly than he was scheduled to actually. so maybe it was because he was eager to get on with his anniversary celebration but he clearly did not wish to be in the debate hall for one second longer than he had to be last night. >> i noticed that the romneys were still on stage and the crowd was cheering and the president was gone already. melissa griffin, live in denver, thank you. >> we'll see what the independent voters have to say. that's the big question. developing news in san jose where police have two homicides to investigate from a violent

night. a man was shot to death in east san jose about 12:30 this morning. a group was garbed outside a home when some people with rags on their faces opened fire. there was another murder on south second street in downtown san jose. police were called about a fight there. they found a man unconscious at the time. got little to the hospital. he didn't make it. no word on suspects or motive. a new roman catholic archbishop of san francisco will be installed today. 2,000 people will witness the ceremony for salvatore cordileone at st. mary's cathedral. but protestors are expected. that's because the bishop has a reputation as a fierce defender of the church's opposition of same-sex marriage. gay activists say they want their voices to be heard. 6:58. a last check of traffic and weather. after three beautiful days, times are changing. >> times are changing ready for cooler weather. better sleeping weather at night and i have been getting bit by mosquitos earlier this week, too. so hopefully all that will go
